I am over the age of eighteen and make this Affidavit based upon my personal knowledge. 
I am the owner (or authorized representative of the owner) of the premises known as:
_______________________________________________________________. (the “Premises”).

I make this Affidavit for the benefit of the purchaser, its successors and assigns, and any title insurance company issuing a policy of title insurance in connection with the conveyance of the Premises. 

The Premises are presently vacant and unoccupied. 

No person presently resides at the Premises, and no person uses the Premises as his or her primary or secondary residence. 

There are no tenants, occupants, licensees, squatters, or other persons in possession of the Premises. 

 No person has any lease, tenancy, right of occupancy, possessory interest, or other agreement, whether written or oral, entitling such person to occupy or possess the Premises. 

There are no pending eviction proceedings, landlord-tenant proceedings, or occupancy disputes affecting the Premises. 

No keys, access devices, or rights of entry have been provided to any person claiming a right to occupy the Premises, except as may be necessary for maintenance, inspection, marketing, or closing purposes. 

Affiant has no knowledge of any person asserting or intending to assert any claim of possession or occupancy of the Premises. 


This Affidavit is made to induce the purchaser to accept title to the Premises and to induce the title insurance company to issue its policy of title insurance without exception for the rights of parties in possession. 

Affiant understands that the purchaser and the title insurance company will rely upon the truth of the statements contained herein.
